Tolerance, an agency with 20 years of experience in the Turkish real estate market, shares information about new requirements for individuals and legal entities utilising electronic means to post advertisements for selling property and secondary motor vehicles.
From 1 November 2023, an individual looking to post an advertisement for sale must provide their name, surname, and Turkish citizenship identity number (T.C.) or foreign identification number, as well as a phone number.
A legal entity must confirm its name and phone number, verify the accuracy of confirmed data, and there is an obligation to keep it.
There's also a requirement to confirm that the motor vehicle or property listed in the ad belongs to the person posting the advert or that the person posting the ad has authority from the owner of the motor vehicle or property.
According to these requirements in Turkey, an Electronic Advertisements Verification System (EİDS) has been established under the Ministry of Commerce.
This system provides the capability to verify the identity and powers of individuals or legal entities wishing to post an ad.
According to the Decision dated 31 August 2023 on the trade of secondary motor vehicles and the Decision related to real estate transactions, changes have been made that allow for electronic advertisements for the sale of others' secondary motor vehicles and property on electronic platforms by individuals or legal entities:
- An individual looking to post an advertisement must provide their name, surname and Turkish citizenship identity number (T.C.) or foreigner's identification number, as well as a phone number; confirmation of the name and phone number of a legal entity; the obligation to confirm and maintain the accuracy of the provided information and store it.
- It is mandatory to confirm the fact that the secondary motor vehicle or property, about which an advertisement has been posted, belongs to the registered user, or if it's an individual, their closest relative of the first and second degrees or spouse, or that the advertisement was posted on behalf of the owner of the vehicle or property with which an agreement has been made.
The goal of these changes is to prevent the placement of false, deceptive or fraudulent adverts about second-hand motor vehicles and property on online platforms, as well as to prevent information chaos in the adverts and speculative price increases for motor vehicles and property.
Those who act contrary to these rules will be subject to administrative penalties of up to 100.000 Turkish lira for each violation according to paragraph (d) of Article 12 of the Law on Regulation of Electronic Commerce No. 6563.
To ensure the fulfilment of the aforementioned duties, a decision was made to create an electronic advert verification system (EİDS) in the Ministry, involving representatives of the motor vehicle and real estate sectors, representatives of advert platforms, and representatives from the President's Office for Digital Transformation.
With this system, individuals and legal entities who place adverts for the sale of other people’s motor vehicles and property on electronic platforms will have the ability to verify identity and authority:
- When submitting an application for registration for new members;
- For existing users before posting their first advert.
